Gentleman has £15,000 debt written off

‘Judge believes floodgates to claims could open’.

A Wetherby man has had over £15,000 of credit card debt written off after Royal Bank of Scotland backed down from a showdown with Solicitors hours before the case was due to be heard in a Leeds court.

Judge Langan at Leeds County Court believes that the lender didn’t fight the case because it feared highlighting failings and opening the floodgates to further claims.

Self-employed Mr. Mitchell, 60, had a judgment against him after delaying payments to his credit card while he waited for the bank to supply specific information that he had requested on a number of occasions. He successfully appealed that this judgment should be set aside and turned to support from The Claims Warehouse service.

Debt Discharge and Bankruptcy

Published: Jul 12th, 2009 | Author: morgan Add Comment

During times of serious financial difficulties, people may wonder how they will ever escape their mounting debts and regain financial stability. Individuals who have trouble paying their bills, making their mortgage payments and supporting their family may not be able to envision a life free from harassing calls from creditors and other financial burdens. People facing dire financial situations may turn to bankruptcy to discharge some of their debts and rebuild their finances.

During bankruptcy proceedings, certain debts may be discharged completely, while others may not be eligible for discharge. Under federal law, a discharge releases individuals from liability for specific debts. This wholesale dismissal differs from payment plans and other resolutions that may be reached with creditors. In the case of discharge, the debtor may not be held liable for any debts owed to creditors and following bankruptcy, the individual may not need to make any payments on the debt.

The Odds of the $8,000 Tax Credit Jumping to $15,000

Published: Jul 7th, 2009 | Author: morgan Add Comment

This is pretty good news. The Republican senator from Georgia, Johnny Isakson, has introduced legislation that would increase the amount of the present tax stimulus from $8,000 to $15,000. It would also remove the financial caps that are now in place, making it open for more than just first time homeowners.

Sometimes it’s nice having someone working on bills in Congress who did that as a profession in the real world, as Isakson has a background in real estate. His participation was big in getting the initial $8,000 tax credit passed to begin with, and he believes it’s been successful so far. But he also believes that it’s insufficient because, in his own words, “We don’t have a recession in first-time home buyers, we have a recession in the move-up market.” The hope is to take advantage of the reality that there are plenty of very nice homes that have been foreclosed upon, and that a present home owner might like to have the chance on improving their lot a bit with something fancier and larger.

What You Don't Know About Debt Consolidation Could Hurt You

Published: Jul 2nd, 2009 | Author: morgan Add Comment

Debt consolidation may seem like the easy way out, but there are many things to consider before opting to use it. Many debt reduction counselors will tell you that consolidation will help you get current with your bills and debts. However, what you don’t know about consolidating your debt can really hurt you.

Consolidation is often advised when someone is paying down credit card debt. Since these interest rates can reach 22% or higher, even an unsecured consolidation loan from a bank can save you money on interest. On a $10,000 credit balance, a consolidation loan that is a measly 6% lower than your card’s interest rate can save you $600 over the course of a year.

The first step towards your financial freedom is to do an evaluation of your debt. This is where you have to be brutally honest. Look at all your expenses. Mortgage or rent, insurance, taxes, food, car payments, and credit card bills. List everything . Start with the monthly recurring bills, like your mortgage/rent and car payments. And the everything else.

Now you know what you spend every month and you know what your monthly take home pay is, so are you a “victim” of deficit spending? Are you going deeper into debt every month? If the answer is yes, then you need to take action to turn it around.

Bankruptcy – Saving Whatever is Left and Starting Over

Published: Jun 27th, 2009 | Author: morgan Add Comment

Bankruptcy is the thing all people fear if they are heavily in debt and represents to most the loss of everything including all their disposable major assets such as their home, furniture and car.

In many cases, bankruptcy itself is a relief after a prolonged period of struggling with credit card bills, utility bills, tax bills and other debt related obligations they will not have been able to cope with for some time.

Unmanageable debt is incurred when a person becomes involved with more financial outgoings than they can comfortably handle. Sometimes, the person will approach a lender who is offering unreasonable interest rates, to buy short term relief from pressure. This decision can prove to be ill advised when monthly payments escalate even further on a limited income.
